Resolution No. 257-05

 

The Board of Logan County Commissioners met in regular session on this date of June 7, 2005 with the full board present.

Mr. Jack Reser moved that the following resolution be adopted:

RE:  County Donation Program

WHEREAS Logan County will benefit from a program to donate unneeded personal property owned by the county, and

WHEREAS Ohio Revised Code section 307.12(B)(2) provides authority for the donation of such property to Federal Tax-exempt organizations in the State of Ohio under 26 United States Codes section 501(a) and section 501c(3),

THEREFORE BE IT RESOLVED THAT the Board of Logan County Commissioners intend to make unneeded personal property available to 501c(3) organizations, and

BE IT FURTHER RESOLVED THAT the donation program will be conducted by Mr. Brian Dunn, at the Logan County Commissioners office, located at 117 East Columbus Avenue, Bellefontaine, Ohio, (937) 599-7280 and

BE IT FURTHER RESOLVED THAT the county donation program be conducted under the attached guidelines.

Statement of Policy:

 

The Board of Logan County Commissioners intend to make unneeded personal property owned by the county available for donation to Federal tax-exempt organizations under section 501c(3) of the United States Code.  Property valued at $4,500 or less may be donated trough this program.

   
 

What is a 501c(3) Organization?

 

Section 501c(3) organizations are those that are organized exclusively for religious, charitable, scientific, public safety testing, literary, or educational purposes, or to foster national or international sports competition, or for the prevention of cruelty to children or animals.  No part of the net earnings of a 501c(3) organization may be used to benefit any private shareholder or individual.  No substantial part of their activities may be used for the carrying on of propaganda or otherwise attempting to influence legislation, nor may its activities involve participating in, or intervening in political campaigns on behalf of, or in opposition to, any candidate for public office.

   
 

How 501c(3) Organizations may participate in the Donation Program:

 

Any 501c(3) organization that desires to obtain unneeded personal property from Logan County must submit written notice to the Board of Logan County Commissioners.  The written notice should include:

 

     1.  Evidence that the organization is exempt from Federal taxation under section 501c(3),

 

     2.  Evidence that the organization is located within Logan County or the State of Ohio,

 

     3.  A description of the organization's primary purpose,

 

     4.  The type of property the organization is requesting; and

 

     5.  The name, address, and phone number of the organization, or its program agent as designated by the organization's governing board.

   
 

Maintaining a list of Eligible Organizations and Unneeded Property Items to be offered:

 

The Logan County Commissioners office will maintain a list of all eligible 501c(3) organizations that submit notices as described above.  The Commissioners office will also maintain a list of unneeded property items being offered for donation, which will be posted continually at these locations:

 

     1.  The Logan County Commissioners Office, 117 E Columbus Ave, Bellefontaine, OH 43311

       2.  The County Auditor's Office, 100 S Madriver St, Bellefontaine, OH 43311
       3.  The Logan County website:  www.co.logan.oh.us
   
  Priority Ranking Among Eligible Organizations:
  The Board of Logan County Commissioners may, at some time in the future, designate by Resolution eligible organizations to be given priority consideration for the donation of particular unneeded property or specific types of items.  In each case, a reason for giving priority consideration will be stated.  Generally, priority consideration will be given to organizations that have a direct relationship with the specific public purposes or programs provided by, or administered by, the Board of Logan County Commissioners.
   
  Donation of Vehicles:
  In addition to the provision stated above, county-owned vehicles valued at $4,500 or less may be donated directly to an eligible organization for the purpose of meeting transportation needs under the Ohio Works First Program.
   
  Sale or Donation to Public Entities:
  Property of any value may be sold to the Federal Government, the State of Ohio, or any political subdivision of the State of Ohio without advertisement or public notice.
   
  Sale of property valued at $2,500 or less:
  In addition to the provisions stated above, unneeded property valued at $2,500 or less may be sold to a private party without advertisement or public notice.
   
  Ethics Law Considerations:
  The Ohio Ethics Commission will first be consulted if any unneeded property will be donated to an organization in which a member of the Board of Logan County Commissioners, any member of a commissioner's family, or if any business associate of a commissioner is a trustee, officer, board member, or employee of the organization.  The Board of Logan County Commissioners will assure compliance with all applicable Ohio ethics laws before making any donation.
   
  Public Notice of Donation Program:
  Once the donation program has been adopted by Resolution, notice of the Board of Logan County Commissioners' intent to donate property will be published at least twice in a newspaper of general circulation in Logan County.  The second notice will be posted between 10 and 20 days after the first notice.  A similar notice will be published in the Commissioners' office, the Auditor's office, and on the Logan County website.   Public Notice
